If your BAC is between .08% and .099%, your penalties will include:

  • 12-month license suspension

If your BAC is between .10% and .159%, your penalties will include:

  • 90 days mandatory prison time, and up to five years in jail

If your BAC is .16% or higher, your penalties will include:

  • Now a third-degree felony
  • one year mandatory jail time and up to seven years in prison
  • A fine of at least $2,500 – $10,000
  • 18 months license suspension
  • Ignition interlock required prior to getting your license reinstated
